Chinese HNWIs with offshore trusts, overseas investment structures and international assets are entering a critical compliance period. New offshore-trust rules introduced in July created a 90-day window for addressing certain historic tax liabilities, with the transitional deadline falling on 22 October 2026.
China Has Changed the Tax Treatment of Offshore Trusts
China’s Ministry of Finance and State Taxation Administration introduced a comprehensive framework for the taxation of offshore trusts on 24 July 2026. The rules clarify how Chinese individual income tax can apply throughout the lifecycle of offshore trust arrangements, including the contribution of assets, income earned during the trust period, distributions, termination and certain changes involving tax residence or succession.
The framework uses the existing 20% rates applicable to relevant categories such as property-transfer income and interest, dividends and bonus income. Importantly, specialist analysis stresses that this is not simply a new flat 20% tax applied to the gross value of every offshore trust. At establishment, for example, a resident contributor may face tax on the gain represented by market value less cost basis and qualifying expenses rather than on the entire value transferred.

October Deadline Makes This Story Urgent
The rules included a 90-day transitional period allowing certain historical liabilities to be regularised without late-payment surcharges. Specialist tax guidance calculates that window as closing on 22 October 2026, making the coming weeks particularly important for affected individuals and trustees. Historical arrangements dating back to 2023 and certain income connected with older trusts may fall within the transitional provisions.
For a wealthy family with several offshore trusts, underlying companies and portfolios spread between Hong Kong, Singapore, the Caribbean, Europe or other jurisdictions, identifying what falls within the regime may not be straightforward. The practical exercise may require tracing original asset costs, distributions, accumulated income, residence status and effective control across several years.
Offshore Structures Are Becoming Increasingly Visible
The new trust rules sit within a broader shift in China’s approach to offshore wealth. Reuters reported at the end of September that Beijing is intensifying scrutiny of overseas assets and international financial structures as Chinese private wealth outside the mainland has expanded dramatically. Hong Kong alone has become the world’s largest cross-border wealth centre, with approximately US$2.9 trillion under management according to figures cited by Reuters, much of it connected to mainland Chinese investors.
Greater cross-border financial transparency also changes the practical meaning of an offshore structure. International account reporting, beneficial-ownership data and tax-information exchange make it much harder to assume that an asset held through a foreign trust, broker or insurance policy sits outside the information environment available to the individual’s home tax authority.
Offshore Insurance and Investment Income Are Also Under Pressure
Trusts are not the only focus. Chinese authorities have also increased scrutiny of gains associated with offshore insurance products and overseas investments. In August, the South China Morning Post reported confirmation from a Shanghai tax official that personal income tax was being levied at 20% on gains from certain offshore insurance policies, adding another compliance layer for structures that had long been popular among mainland HNWIs seeking international diversification.
This does not mean that offshore insurance, trusts or foreign securities are inherently problematic. International wealth structures can serve legitimate succession, investment, asset-management and family-governance purposes. The fundamental change is that they increasingly need to be designed and maintained on the assumption that the relevant tax authorities can see and analyse them.
Leaving China Does Not Necessarily Solve an Existing Structure
For HNWIs considering relocation, the natural temptation may be to assume that changing tax residence will automatically remove the problem. In reality, the new offshore-trust rules explicitly address circumstances involving changes in residence, while specialist analysis notes that economic connections, control and Chinese-source assets can remain relevant even where foreign nationality or overseas residence exists.
A relocation strategy therefore needs to distinguish between physical movement and the tax treatment of an existing structure. A family can establish residence in Singapore, Dubai or elsewhere while still retaining companies, trusts, investments or economic interests that create continuing tax or reporting obligations in another jurisdiction.

Family Offices Need a Compliance Map, Not Just an Asset Map
For Chinese HNW families, the most valuable exercise may now be creating a complete map of who owns, controls and benefits from international assets. A conventional family-office balance sheet explains what the family owns. A compliance map goes further by identifying the settlor, trustee, beneficiaries, underlying companies, residence of each family member, source of capital, accumulated income and reporting obligations in every relevant jurisdiction.
That discipline is becoming increasingly important globally. Governments from China to the UK are investing in better data and more sophisticated scrutiny of cross-border wealth. The era in which complexity alone created privacy from tax authorities is being replaced by one in which the strongest international structure is the one that remains defensible under full transparency.
