America Raises EB-5 Investor Visa Fees as the Cost of a US Green Card by Investment Climbs

The United States has finalised a new EB-5 fee schedule that takes effect on 30 November 2026, sharply increasing several of the government charges associated with investor immigration. For HNWIs considering US permanent residence, the change reinforces the need to calculate the full cost of EB-5 rather than focusing exclusively on the headline investment threshold.

New EB-5 Fees Take Effect on 30 November

The US Department of Homeland Security published its final EB-5 fee rule on 30 September 2026, confirming that applications, petitions or requests postmarked on or after 30 November must carry the new fees. DHS says the changes are intended to recover the full cost of administering the programme, fund integrity and compliance measures and help USCIS meet statutory processing goals.

For individual investors, the new fee for a standalone Form I-526 petition will be US$7,615, while the initial Form I-526E used by regional-centre investors will cost US$7,850. Form I-829, used by qualifying conditional permanent residents to remove the conditions from their status, will carry a US$5,000 filing fee. DHS has also introduced or adjusted a range of charges affecting regional centres and other entities operating within the EB-5 ecosystem.

Government Charges Are Only One Layer of EB-5 Economics

The core EB-5 capital requirements remain far larger than the filing fees. The programme generally requires an investment of at least US$1.05 million, or US$800,000 where the qualifying investment is made in a targeted employment area or qualifying infrastructure project. The underlying investment must also satisfy job-creation requirements, with the programme generally requiring the creation of at least ten full-time US jobs.

That means an investor evaluating EB-5 has several different cost categories to consider. There is the qualifying capital itself, government filing fees, legal and professional expenses, due diligence, possible regional-centre or project-related fees and the economic risk associated with the underlying investment. The residence benefit may be extremely valuable to the right family, but EB-5 should never be evaluated as though the only figure that matters is US$800,000.

The Programme Is Becoming More Compliance Intensive

DHS says the new fee structure reflects a programme that now includes significantly greater integrity and compliance responsibilities following the EB-5 Reform and Integrity Act. Those responsibilities include background checks, site visits, compliance audits and expanded review of how investment capital was lawfully obtained and transferred. The final rule also includes funding mechanisms intended to support the technology and administrative infrastructure behind those reviews.

For an HNWI applicant, source-of-funds documentation can therefore be just as important as investment selection. Entrepreneurs may have accumulated capital through business exits, dividends, property transactions, shareholder loans or family transfers across several jurisdictions. The fact that an applicant clearly possesses enough wealth does not eliminate the need to reconstruct a documented legal path showing how the specific EB-5 capital was generated.

EB-5 Is More Than an Investment Visa

The central attraction of EB-5 remains that it is a route towards permanent US residence rather than merely a temporary permission to live in the country. For families with children studying in the United States, founders expanding US businesses or HNWIs who genuinely intend to establish a long-term American base, that distinction can make the programme strategically important.

However, permanent residence also brings consequences that differ fundamentally from holding a residence permit in many other jurisdictions. US tax rules generally reach far beyond the country’s borders for US tax residents, meaning that worldwide income, foreign financial accounts, companies, trusts and investment structures may become relevant. Immigration planning should therefore be coordinated with international tax planning before the family becomes deeply embedded in the US system.

Filing Before the Deadline Requires More Than Speed

The 30 November effective date naturally creates an incentive for some investors to consider whether an application can be filed before the higher fees become mandatory. That does not mean investors should rush incomplete applications simply to save administrative costs. With hundreds of thousands of dollars of capital at stake, project quality and application integrity outweigh the savings created by an earlier filing date.

Investors who were already preparing an EB-5 application may nevertheless have a clear reason to review their timetable immediately. Where the qualifying investment, source-of-funds file and legal documentation are genuinely ready, the new deadline introduces a practical cost consideration that did not exist before the final rule was published.

The Real Question Is Whether America Fits the Family Strategy

EB-5 cannot be evaluated purely against Golden Visas in Europe or residence programmes in the Gulf because the long-term proposition is different. The United States offers access to one of the world’s largest economies, deep capital markets, leading universities and a major entrepreneurial ecosystem, but it also imposes a complex immigration and tax framework.

For globally mobile HNWIs, the correct question is therefore not whether EB-5 is expensive. It is whether US permanent residence provides enough commercial, educational, lifestyle and generational value to justify both the investment and the long-term compliance obligations that accompany it.

RELOC8 ONLINE helps internationally mobile families compare residence programmes within the broader context of tax residency, investment structures, family objectives and long-term wealth planning.
